Marbury v. Madison, 5 U.S. (1 Cranch) 137 (1803) was his landmark
decision.
That was when the SCOTUS decided they could throw out any legislation
they deemed unconstitutional.
On the one hand it was one of the checks on power envisioned by the
founding fathers but it is subject to abuse by as few as five people.

How the heck can anyone follow the laws if SCOTUS doesn't have a unanimous
ruling? They are written by lawyers, for lawyers. SCOTUS interprets the laws vs
the Constitution, state judges do the same. It's Kabuki theater.

The law is what only 5 out of the 9 justices say it is. Many times they
have a say so after lower courts have already expressed their opinion.
I still think it should be all or at least 2/3 of them as it is
difficult to get that many people to agree on every thing.

The first gulf war would have been a win if GHWB had just picked up

defeat from the jaws of victory and set up a situation that let his
idiot son invade Iraq.
We killed Saddam, HWs goal but you certainly can't call the ISIS
wonderland we created a win.
Our NATO ally Turkey will still be persecuting the Kurds long after we
forget about that mistake.

This is nitpicky but the United States hasn't been in a declared war since WWII. Everything since has been
a conflict or whatever.
The news people keep saying we're ending our longest war by leaving Afghanistan. Twenty years of Afghanistan compared to sixty eight and counting in Korea. I wonder what criteria the news people are using.

The way I look at it is that any time the military is involved in
shooting in another country it is a war. Call it what ever you want.
From the end of WW2 all the 'actions' have only involved getting a bunch
of our people killed and almost no results.

It is mostly political actions. The way I look at is the civilian
government should declare what the objective is and step back and let
the military do what ever is needed to obtain the objective.

Maybe the Desert Storm was one of the few actions like that. Go do
something and get out.

What's so hard? The SC issues a ruling based on a majority, that ruling is
then the decision of the SC.

Alas we didn't get out tho. The Neocons made up an excuse to keep the
war against Iraq going until they could invade on another lie.

We did kill Saddam but like the death of Qdaffy it just resulted in
chaos that allowed a terrorist sanctuary to arise from the ashes.
