NEW YORK — The migrant crisis is getting so hard for New York City to
handle that Mayor Eric Adams sees a policy that could send thousands of
people into the streets, many with nowhere to sleep and nowhere to work,
as his next best move.

A senior Adams administration official said on Thursday that the city is
preparing to ask a judge to exempt newly arrived migrants from its
right-to-shelter mandate, which requires the city to provide a bed to
anyone who asks for one.

“We’re back in court next week to really say, ‘I don't think that the
right to shelter as it was originally written should be applied to this
humanitarian crisis in its present form,’” Anne Williams-Isom, the
deputy mayor for health and human services, told WNYC’s Brian Lehrer.

Her remarks signal a potentially complicated legal battle around the
city’s 40-year-old right-to-shelter mandate, which could have broader
implications for undocumented immigrants and their access to safety net
services.

Single migrants would be kicked out of New York City shelters within 30
days — half the current allowed stay — under proposed new rules being
floated by the Adams administration, sources told The Post on Tuesday.

Migrant families also would be limited to 60-day stays, as opposed to
their current unlimited amount, under the plan, according to the outlet
The City.

City Hall has informally “floated” the plan in an ongoing effort to free
up space in the Big Apple’s overwhelmed shelters and discourage new
arrivals from coming, according to the local government sources.

Reality is finally beginning to dawn on New York’s public officials:
Wednesday, Gov. Kathy Hochul called for an end to New York City’s insane
“right-to-shelter” rule.

Until now, officials like Hochul and Mayor Eric Adams have wrongly
stated the rule — stemming from a 44-year-old consent decree — requires
the city to provide shelter to any and every comer, the minute they seek it.

Yet President Joe Biden’s open-border policy has led to hundreds of
thousands of migrants swamping the state, with not enough shelter space
to accommodate them all.

And with no end in sight.

That seems to have opened some eyes.

As Hochul herself now notes, that crazy interpretation of the rule could
theoretically force the city to accommodate the whole world.

“The original premise behind the right to shelter was, for starters, for
homeless men on the streets,” the gov explained; it was later extended
to families.

“But never was it envisioned being an unlimited universal right, or
obligation on the city, to house literally the entire world.”
