I'm in Illinois.

A couple of years back, after the death of George Floyd, and with a
change of leadership in the legislature, a massive criminal justice
reform bill was written within days and with very little thought. The
provision that got the most publicity was no-bail bond, eliminating
pre-trial detention for a hell of a lot of crimes. There'd have to be a
bond hearing in which the prosecution was well prepared to argue that
the defendant was a danger to the community in order to be held till
trial.

And the prosecutor was prevented from raising issues of missed court
appearances, you know, the very thing cash bail was supposed to
encourage.

What should have happened all along were those who were accused of
committing crimes in violation of conditions of custody, like during
probation or parole or while on bond pending trial, should be held until
trial. Violate probation or parole, you are supposed to be sent to
prison, not county jail.

During the gubanatorial debate, the governor running for re-election who
signed the bill got slammed for it, and the Democratic Party was in real
trial as the bill's effective date for these provisions was delayed
till January 1, 2023.

Sen. Scott Bennet, a former prosecutor, became the point person on
communication with state's attorneys (county prosecutor) around the
state, nearly all of whom opposed the legislation. He wrote amendments
to the legislation that helped to improve much of the problematic
language but didn't change the gist of the bill.

The amendments passed and the governor signed them into law. He pretty
much bailed out the Democratic party.

Just days after the governor signed the amendments into law, he died. To
contradict Ah'nold's famous line, it actually was an undiagnosed brain tumor.
